UPDATED Emergency Proclamation regarding community spread of COVID-19 III

WHEREAS, The World Health Organization has declared Novel Coronavirus-19

WHEREAS, COVID-19 poses a serious threat to the public health and safety of the City of Polk City, Iowa; and

WHEREAS, On March 17, 2020 the Honorable Governor Kim Reynolds issued a State of Public Health Disaster Emergency throughout the State of Iowa; and 

WHEREAS, As directed by SECTION THREE of Governor Kim Reynolds Proclamation, pursuant to Iowa Code § 135.144 (3) and in conjunction with the Iowa Department of Public Health unless otherwise modified by subsequent proclamation or order of Iowa Department of Public Health: 

1.       Restaurants and Bars: All Restaurants and Bars are hereby closed to the general public except that to the extent permitted by applicable law, and in accordance with any recommendations of the Iowa Department of Public Health, food and beverages may be sold if such food or beverages are promptly taken from the premises, such as on a carry-out or drive-through basis, or if the food or beverage is delivered to customers off the premises.

2.       Fitness Center:All fitness centers, health clubs, health spas, gyms, aquatic centers are hereby closed.

3.       Theaters: All theaters or other performance venues at which live performances or or motion pictures are shown are hereby closed.

4.       Casinos and Gaming Facilities: All casinos and other facilities conducting pari-mutuel wagering or gaming operations are hereby closed.

5.       Mass Gathering: Social,community,spiritual,religious,recreational,leisure, and sporting gatherings and events of more than 10 people are hereby prohibited at all locations and venues, including but not limited to parades, festivals, conventions, and fundraisers. Planned large gatherings and events must be canceled or postponed until after termination of this disaster.

6.       Senior Citizen Centers and Adult Daycare Facilities: All facilities that conduct adult day services or other senior citizen centers are hereby closed.

7.       All retail businesses.

 

WHEREAS, Unless otherwise modified by subsequent proclamation or order of Iowa Department of Public Health, this order is effective from March 17, 2020 and continuing until 11:59 p.m. on April 7, 2020; and

WHEREAS, Governor Reynolds declared the State of Disaster Emergency effective on March 16, 2020 and shall continue for thirty (30) days, and shall expire on April 16, 2020 at 11:59 p.m., unless sooner terminated or extended in writing; and 

WHEREAS, Section 15.02(2) of the Code of Ordinances and Section 372.14(2) of the Code of Iowa (2019) grant the Mayor powers to declare an emergency and govern through proclamation to protect the health and safety of the citizens of Polk City.

NOW THEREFORE, I, Jason Morse, the duly elected Mayor of the City of Polk City, do hereby proclaim the following:

1.       That a state of emergency or public danger exists within the City of Polk City because of the threat of the spread of COVID-19 virus.

2.       That based upon the advice of the CDC and other public health agencies, I hereby declare that the Public Library and City Hall will be closed to the public beginning upon execution of this Proclamation. Staff shall report as normal.

3.       All Polk City Parks and Playground equipment are closed to the public until further notice.

4.       That pursuant to the State of Public Health Disaster Emergency issued by Governor Reynolds, mass gatherings of 10 or more people are prohibited from March 17, 2020 and continuing until 11:59 p.m. on April 7,2020. 5.       That pursuant to the Governor’s mandate that all restaurants, bar, fitness centers, theaters, senior citizen centers and adult day care facilities in Polk City be closed; with the exception to allow food being served by carry-out, drive-through or delivery.

6.       That all residents are encouraged to regularly monitor trusted sources including Federal, State and local informational resources for possible emergency communications, updates and additional recommendations.

7.       That this Proclamation of Emergency may be modified and/or superseded by future proclamation of the Office of the Mayor of Polk City as future events warrant. 

8.       That any violation of any proclamation of the Office of the Mayor shall be enforceable by the Polk City Police Department and any violation of the same shall be a violation of Section 15.02(2) of the Code of Ordinances and punishable as a simple misdemeanor.
